The tenant is paying the eviction lawyer but not me?

alright so the dude has hired a lawyer because i have started the eviction process. He hasnt paid rent since march 15th…. umm does anyone have an opinion on the matter, ive done my homework with the whole 3 day notice to quit dealy and i served him a 30 day written notice that hes gotta leave in april. Any advice?

I would just let it play out. If he hasn’t paid rent in that long then you have every right to evict him. The only way that he will win is if for some reason he can prove that the home was in unlivable condition and that you were notified and did not fix the problem. So like i said I would just let it play out and go to court. He will most likely lose and you wont have to pay a dime for the court cost or anything.

It depends on your judge. You go back to the same one.
The options are using a collection agency, or wage garnishment. Since you already lost the house the judge will likely require you to try a collection agency for a year, then come back and get an order to garnish wages. But ask for the garnishment up front, you might get it, depends solely on the discretion of the judge. Emphasize the great hardship you have endured because of their greed, you would not have lost this property if those dead beats had not stolen income from the mouths of your babies.

A good way to prolong your stay is to pay your rent. Like anything else, owning income property is a business. Your landlord is not in business to give you a free place to live. If you are honest and TRY to work with your landlord, they might be able to work with you. An eviction on your credit report is not a good thing. Good luck,

I have no idea of what you are trying to accomplish. I don't know what you mean by "take care of an eviction from 2005." Figure out what you want to know and ask it.
How are looking to resolve it? I'm guessing that if the eviction happened in 2005 you're no longer a tenant at the premises. Was there a money judgment entered against you? If so, the only way to "resolve" it is to pay the judgment amount.

I assume you have had your wages garnished. That you have paid some, but not all the money you owe.
Your judgment-creditor (old landlord) is not required to do anything until you completely pay off the judgment. Once you do she is required to file a "satisfaction of judgment" with the court.
In the mean time there is absolutely no requirement that she give up any of her rights in judgment enforcement. So if you loose or quit your job, the sheriff could inventory your stuff and schedule a sale to satisfy the judgment.
If you want to find out the payoff, simply tell the lawyer you want a payoff amount. They should be able to give that to you right away. If you believe that amount is incorrect, send them a letter telling them why.
Well you have access to a computer so you have some ability to research things. You can go to small claims court and file an unlawful eviction and get the maximum from your landlord. While you are waiting go to Department of social services to get aid for your family until you get back on your feet. That will cover medical care and daycare for the kids. They will even be able to put your wife in a school program to become a nurse or other types of job training. They can even provide emergency housing vouchers as well. Use the government resources available to get yourself up on your feet and keep your family together. Any lawyer is going to cost you for this case and the courts will only restore you back to the status you were before. You will not receive a huge award and will have wasted time and energy better spent on getting through this. Good luck!
