LennyAsked:

I hold a Power of Attorney from a family member. At the time of creation of the Power a few years ago, neither the Lawyer who prepared it nor the Notary Public who notarized it, thought it necessary to provide on the Power document a specimen of my signature,
The document has been accepted as regular by several leading Banks and Mutual Funds. Recently one Mutual Fund has rejected the P/A stating reason “the Power Holders signature is missing on the document” That is why I am raising this question,

Reply:

Legally, “no”, it is not required.

Leigh Asked:

My nephew was convicted of a white collar crime in 1995 and sentenced to California State Prison for 3 years. He served 18 months and 18 days (half time) because he was credited with time off for good behavior and time off for work credits.

Now he’s facing a one year term in the county jail (Sacramento County) for a different white collar crime. How much time will he serve? Does Sacramento County offer time off for good behavior and time off work credits? How does the county jail system work for time off?

Reply:

Conduct credits in County Jails will take off 1/3 of the sentence, so 12 months equals 8 months in custody. However, there are other things that can affect this, and result in less time. Jail overcrowding can result in early release (although I have not heard of such problems in Sacramento County). Some prisoners are placed on what is called “County parole.” But if he does not get in trouble, the longest he would serve would be 8 months.
